These Terms govern your use of JotalyzeTM, including the mobile app, website, and related services.

These Terms & Conditions (“Terms”) govern your use of the Jotalyze mobile application, website, and related services (collectively, the “Service”), operated by Adam Heidmann (“Jotalyze,” “we,” “our,” or “us”).

By downloading, accessing, or using Jotalyze, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 9 years old to use Jotalyze.

If you are under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian.

2. The Service

Jotalyze is a journaling and reflection app that may include:

  • local journal entry storage
  • optional iCloud sync
  • local analytics and insights
  • optional premium subscription features

We may change, improve, suspend, or discontinue parts of the Service at any time.

Analytics, mood scores, charts, and recurring keyword or theme insights are automated outputs and heuristic summaries that may be inaccurate, incomplete, or out of context.

3. Journal Content and Your Responsibility

You are solely responsible for the content you create, store, upload, or submit through Jotalyze, including journal text, photos, mood selections, and any other material (“User Content”).

You represent that:

  • you have the rights necessary to create or submit your User Content
  • your use of the Service does not violate applicable law or the rights of others

You retain ownership of your User Content, subject only to the limited rights necessary for Apple, Firebase, RevenueCat, and other service providers to operate the features you choose to use.

4. Local Storage and iCloud Sync

By default, journal content is stored locally on your device.

If you enable iCloud Sync:

  • your journal entries and related images may be stored in your private Apple CloudKit / iCloud environment
  • syncing depends on Apple services and your iCloud account
  • disabling iCloud Sync stops future syncing, but does not automatically remove content already stored in your iCloud environment

We do not guarantee uninterrupted sync availability, successful delivery of all updates, or conflict-free synchronization under every circumstance.

5. Premium Features and Subscriptions

Certain features may require a paid subscription.

Premium features may include, for example:

  • paper journal scanning
  • complete archives
  • advanced analytics
  • iCloud sync-related premium functionality
  • customization or other premium tools

Premium features, feature scope, and availability may be changed, replaced, limited, or discontinued at any time for legal, security, operational, or product reasons.

Access to premium features does not guarantee that any specific feature will remain available permanently.

Premium access does not guarantee unrestricted or unlimited request volume; fair-use and security limits may still apply.

Access to premium features may change if:

  • your subscription expires
  • your subscription is cancelled
  • Apple reports a billing failure
  • Apple reports a refund or revocation
  • entitlement data from Apple or RevenueCat indicates you are no longer entitled to premium access

6. Billing, Auto-Renewal, Cancellation, and Trials

If you purchase a subscription through Apple's App Store:

  • payment is charged by Apple to your App Store account
  • subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Apple may charge your account for renewal within 24 hours before the end of the current billing period
  • you can manage or cancel your subscription in your Apple account settings
  • free trial eligibility, offer availability, renewal terms, and billing timing are controlled by Apple and your App Store account

If you do not cancel before renewal, your subscription renews automatically under Apple's billing rules.

7. RevenueCat

Jotalyze may use RevenueCat to manage subscription status, entitlements, purchase restoration, and related billing-state functionality.

RevenueCat is used to help determine whether your account or device should have access to premium features, but RevenueCat is not the merchant of record for App Store purchases.

8. Refunds

For subscriptions and purchases made through Apple's App Store:

  • refunds are handled by Apple, not by Jotalyze
  • cancellation and refund decisions are subject to Apple's policies and processes
  • Jotalyze does not guarantee refunds for App Store purchases
  • if Apple reports a refund, cancellation, revocation, or expiration, premium access may be removed or adjusted accordingly

9. Restore Purchases

If supported in the app, you may use the Restore Purchase function to request that Apple and our entitlement systems re-check eligible purchases associated with your App Store account.

Restore Purchase does not create a new purchase and does not guarantee premium access if Apple does not report an active eligible entitlement.

10. Acceptable Use

You agree not to:

  • use the Service unlawfully
  • interfere with or disrupt the Service
  • abuse premium features or attempt to bypass security protections
  • reverse engineer, scrape, exploit, or misuse the Service beyond what applicable law allows
  • use the Service to store or transmit unlawful, infringing, threatening, harassing, or abusive content
  • use automated means to generate excessive requests or abuse backend services

We may temporarily throttle or block requests that exceed operational or abuse-prevention thresholds.

We may limit, suspend, or terminate access to protect the Service, other users, or our providers.

11. Third-Party Services

The Service may rely on third-party providers, including:

  • Apple
  • CloudKit / iCloud
  • Firebase
  • RevenueCat

We are not responsible for outages, policies, acts, omissions, or independent processing decisions of third-party providers.

Your use of third-party platforms or services may also be subject to their terms and policies.

12. Privacy

Your use of the Service is also governed by our Privacy Policy.

13. No Guarantee of Availability or Data Recovery

The Service is provided on an evolving software basis. We do not guarantee:

  • uninterrupted availability
  • bug-free performance
  • permanent data preservation
  • successful sync, restore, or recovery in all circumstances
  • compatibility with all devices, OS versions, or third-party services

You are responsible for your own device, account access, and any backups available through your platform or chosen services.

14. No Professional Advice

Jotalyze is a journaling and reflection tool only.

Nothing in the Service, including analytics, mood insights, or any generated content, constitutes medical, psychological, psychiatric, therapeutic, legal, financial, or other professional advice.

Jotalyze is not a healthcare provider and does not diagnose, treat, cure, monitor, or prevent medical or mental health conditions, and does not provide emergency or crisis monitoring services.

Your use of the Service does not create a therapist-patient, physician-patient, fiduciary, or other professional-client relationship between you and Jotalyze.

If you are in crisis, believe you may harm yourself or others, or need professional support, do not rely on the Service. Contact qualified professionals or emergency services immediately.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

We disclaim all warranties, including implied warranties of:

  • merchantability
  • fitness for a particular purpose
  • non-infringement
  • availability
  • accuracy
  • reliability
  • quiet enjoyment

We do not warrant that the Service will meet your expectations or that any content or insight will be correct or useful.

16. Limitation of Liability

To the fullest extent permitted by law, Jotalyze and its operator shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including damages for:

  • lost data
  • lost profits
  • lost goodwill
  • emotional distress
  • business interruption
  • decisions made in reliance on app content

To the fullest extent permitted by law, if liability is found, our total aggregate liability for claims arising out of or relating to the Service shall not exceed the greater of:

  • the amount you paid for the Service in the 12 months before the claim, or
  • USD $50

Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

Some jurisdictions do not allow certain limitations or exclusions, so some of the above may not apply to you.

17. Indemnity

You agree to indemnify and hold harmless Jotalyze and its operator from claims, liabilities, damages, losses, and expenses arising out of:

  • your use of the Service
  • your User Content
  • your violation of these Terms
  • your misuse of premium features
  • your violation of law or the rights of others

18. Termination

We may suspend or terminate your access to all or part of the Service at any time if:

  • you violate these Terms
  • your use creates risk, abuse, or legal exposure
  • third-party service availability or platform rules require it

Termination does not automatically delete content stored locally on your device or within your own Apple/iCloud environment.

19. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted or otherwise made available through the Service.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.

21. Dispute Resolution and Arbitration

Before filing a claim, you and Jotalyze agree to try to resolve the dispute informally by sending written notice to the contact email listed below and allowing 30 days for response.

Except for claims that qualify for small claims court, intellectual property claims, or requests for injunctive relief to prevent unauthorized use, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration on an individual basis.

Arbitration will be administered by the American Arbitration Association under its applicable consumer arbitration rules, and may be conducted remotely, in your county of residence, or another mutually agreed location.

The arbitrator may award the same individual remedies as a court, subject to these Terms and applicable law.

22. Class Action and Jury Trial Waiver

To the fullest extent permitted by law, you and Jotalyze agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, coordinated, representative, or private attorney-general proceeding.

To the fullest extent permitted by law, you and Jotalyze waive any right to a jury trial for disputes that proceed in court.

23. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within one year after the claim arose, or it is permanently barred.

24. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Our failure to enforce any provision is not a waiver of that provision or any other right.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

These Terms, together with the Privacy Policy, form the entire agreement between you and Jotalyze regarding the Service and supersede prior understandings relating to the Service.

Sections that by their nature should survive termination (including limitations of liability, indemnity, dispute resolution, and miscellaneous provisions) will survive termination.
